Deepfakes present an unusual legal problem because a single synthetic work may simultaneously reproduce copyrighted material, appropriate an individual’s identity and circulate through an intermediary subject to statutory duties. Indian law addresses each of these concerns, yet their interaction remains uncertain. This paper examines that coordination gap within India’s digital media and entertainment industry. It argues for an integrated framework based on four inquiries: Source, Identity, Context and Circulation. It further proposes rights-linked provenance, granular synthetic-performance licensing and harm-sensitive platform remedies. The approach seeks to coordinate existing law while preserving creative expression, individual autonomy and workable intermediary governance.
